I am a foreign company looking to initiate debt recovery in Italy. What documents do I need to provide? To start your debt recovery case, we require the following documents:

Do I need a lawyer to initiate a debt collection process in Italy? You need a licensed attorney to handle judicial debt recovery processes in Italy. Debt collection agencies are not authorized to represent clients in court, which also results in a weaker negotiating position during extrajudicial settlements. Our firm is duly registered and qualified to represent clients in these matters.

What is the limitation period for recovering a credit in Italy? The general limitation period for recovering a credit in Italy is 10 years. However, depending on the type of credit, this period may vary, with some credits having a limitation period of 5 years.

If I succeed in my debt collection, can I recover legal fees from the debtor? Typically, legal fees can be recovered from the debtor. However, the exact amount is determined by the judge, who may award a higher or lower sum based on the specifics of the case.

What should I do if I receive a payment order against an Italian debtor that is temporarily enforceable? We will issue a formal notice, known as a precetto, along with the payment order. If the debtor fails to pay within 10 days, we can proceed with enforcement actions, such as seizing assets, bank accounts, or real estate.

An Italian company has sued me, but there is no jurisdiction in Italy. What should I do? Even if you believe there is no jurisdiction in Italy, it is crucial to hire a lawyer and present a defense. Failure to do so can result in the Italian creditor winning the case by default and obtaining a binding payment order.

What is the role of mediation? Mediation can be an effective way to resolve debt disputes without going to court. It involves a neutral third party who helps both parties reach a mutually acceptable agreement. In Italy, this process is also mandatory for some type of matters in order to start a judicial proceeding. 

How does the mediation process work? During mediation, both parties present their cases to a mediator, who facilitates discussions to find common ground. The mediator does not make a binding decision but helps the parties reach a voluntary settlement. If an agreement is reached, it can be formalized in a written contract.
